The the rich asshole administration’s move on Wednesday to rescind guidance allowing transgender students to use the bathrooms of their choice has raised the stakes for an upcoming U.S. Supreme Court case that could deliver a landmark decision on the issue.
The court is due to hear oral arguments on March 28 on whether the Gloucester County School Board in Virginia can block Gavin Grimm, a female-born transgender high school student, from using the boys’ bathroom. A ruling is due by the end of June.
A key question in the case is whether a federal law, known as Title IX, which bars sex discrimination in education, covers transgender students. The Education Department under Democratic President Barack Obama said in guidance to public schools last May that it does, but the Republican the rich asshole administration withdrew that finding on Wednesday.
Lawyers for Grimm say that the definition of sex discrimination in Title IX is broad and includes gender identity. The school board maintains that the law was enacted purely to address “physiological distinctions between men and women.”
If the Supreme Court rules that Title IX protects transgender students, the decision would become the law of the land, binding the the rich asshole administration and the states.
“This is an incredibly urgent issue for Gavin and these other kids across the country,” said Joshua Block, a lawyer with the American Civil Liberties Union (ACLU) who represents Grimm.
The the rich asshole administration’s announcement “only underscores the need for the Supreme Court to bring some clarity here,” he added.
The administration on Wednesday did not offer its own interpretation of Title IX, with the Justice Department telling the court only that it plans to “consider further and more completely the legal issues involved.”
The administration is not directly involved in the case.
Lawyers for both Grimm and the Gloucester County School Board have urged the court to decide whether Title IX applies to transgender students rather than taking a narrower approach by sending the case back to a lower court.
In a court filing on Thursday, the ACLU said that, regardless of the administration’s position, the court “can – and should – resolve the underlying question of whether the Board’s policy violates Title IX.”
The school board’s lawyers made similar comments in their most recent court filing, saying that the meaning of the federal law is “plain and may be resolved as a matter of straightforward interpretation.”
But the court could take a more cautious approach and send the case back to the Richmond, Virginia-based 4th U.S. Circuit Court of Appeals. That court’s April 2016 ruling in favor of Grimm relied on the Obama administration’s interpretation of the law.
Kyle Duncan, a lawyer representing the school board, said the court must at a minimum throw out the appeals court decision because “the entire basis for that opinion” was the no-longer extant Obama administration interpretation.
JUSTICE KENNEDY: PIVOTAL VOTE?
With the eight-justice court likely to be closely divided, the rich asshole’s Supreme Court nominee, conservative appeals court judge Neil Gorsuch, could end up casting the deciding vote if he is confirmed by the U.S. Senate in time. Otherwise, the court, which is divided equally between liberals and conservatives, could split 4-4, which would set no nationwide legal precedent.
Clues as to how the high court could rule can be gleaned from its decision last August to temporarily block the appeals court decision in Grimm’s case from going into effect. That emergency request from the school board did not require the justices to decide the merits of the case.
The vote in favor of the school board was 5-3, with Justice Stephen Breyer, a liberal, joining the four conservative justices. Breyer made clear in a statement at the time that his vote would not dictate how he would approach the case if the court took the issue up.
That decision indicated that the court is likely to be closely divided at oral argument. Grimm’s hopes may rest in Justice Anthony Kennedy, a conservative who voted against Grimm last summer but has sometimes sided with liberals in major cases, including several on gay rights.
But even lawyers closely following the case are not sure which way Kennedy could go.
“If I could predict that, I would be down in the casino,” said Gary McCaleb, a lawyer with conservative Christian legal group Alliance Defending Freedom, which backs the school board.

When White House spokesliar Sean Spicer demanded that the Anne Frank Center praise some rich asshole for, for the first time since he became President, denouncing the rash of antisemitic violence and other crime that has popped up since his election.
Traditionally, the rich asshole has been terrible with even acknowledging that bad things happen to Jewish people. even omitting them from his Holocaust announcement. But for the first time — that can’t be emphasized enough — he named Jews as the actual victims of antisemitism:
“The anti-Semitic threats targeting our Jewish community and community centers are horrible and are painful and a very sad reminder of the work that still must be done to root out hate and prejudice and evil.”
While some praised the rich asshole for finally doing the right thing, for most it was too little too late — especially when it’s considered that his staff is overflowing with Nazis, white nationalists, white supremacists, white supremacyers, and other synonyms.
“His statement today is a pathetic asterisk of condescension after weeks in which he and his staff have committed grotesque acts and omissions reflecting Antisemitism, yet day after day have refused to apologize and correct the record,” Steven Goldstein, executive director of the Anne Frank Center for Mutual Respect, wrote in a Facebook post. “Make no mistake: The Antisemitism coming out of this Administration is the worst we have ever seen from any Administration.” He added:
“The White House repeatedly refused to mention Jews in its Holocaust remembrance, and had the audacity to take offense when the world pointed out the ramifications of Holocaust denial. And it was only yesterday, Presidents’ Day, that Jewish Community Centers across the nation received bomb threats, and the President said absolutely nothing. When President the rich asshole responds to Antisemitism proactively and in real time, and without pleas and pressure, that’s when we’ll be able to say this President has turned a corner. This is not that moment.”
“I think he’s been very forceful with his denunciation of people who seek to attack people because of their religion, because of their gender, because of the color of their skin,” Spicer lied in response. “It is something that he’s going to continue to fight and make very, very clear has he has no place in this administration.”

During his February 16 press conference, Trump called on Jake Turx, a reporter for the Orthodox Jewish weekly Ami Magazine, because he was looking for a "friendly reporter." As The New York Times noted, the "young correspondent received a tongue-lashing from the president" after he told Trump that he was concerned about "an uptick in anti-Semitism" and wondered what the government would do about it.
Trump interrupted Turx by claiming he's "the least anti-Semitic person that you've ever seen in your entire life," told the Jewish reporter to be "quiet," and said Turx was a liar who asked a "repulsive" question. Turx later saidthat he thinks Trump "clearly misunderstood my question" and he's "with" Trump "when it comes to being outraged about him being charged with this anti-Semitism."
As ThinkProgress noted, Trump declined to denounce anti-Semitism on three separate occasions this week, including at a prior joint press conference with Israeli Prime Minister Benjamin Netanyahu.
Anti-Semitic writers praised Trump's press conference and used his refusal to condemn anti-Semitism as an indication that "everyone is pretty damn sick of Jews."
Editor Andrew Anglin of the neo-Nazi website Daily Stormer wrote that the press conference "was one of the greatest things I've ever witnessed in my life. From start to finish, it was simply beautiful. He blasted the media, the Jews, Mexicans, Obama -- all of his/our enemies." The Daily Stormer worships Adolf Hitler, postsdefenses of the Holocaust, and attacks Jewish people as "kikes."
Daily Stormer writer Eric Striker also praised Trump in an article headlined "Trump Dismisses 'Anti-Semitism' Wolf-Crier, Identifies Fake Hate Crimes as Fake." He wrote:
I'm going to go out on a limb here and make a Striker prediction: this lice infested ghetto Jew will be getting hardcore press coverage and made into a folk hero for a month straight or more. But on the bright side, Jews will gasp when they realize that A) nobody is listening to their fake news or celebrities anymore, and B) everyone is pretty damn sick of Jews.
Striker also claimed that hate crimes against Jewish people are "fake" and that if "there's even an iota of truth to it, let them wallow in their karma. They should shut up and be grateful that anti-Semitism isn't what it should be."
David Duke, a former KKK leader who rails against Jewish people, repeatedly celebrated Trump's answer on his Twitter account, writing, "Are we tired of winning yet, folks?" and claiming Trump's "brain is working bigly." He also praised the "great" press conference, writing that Trump "loves America":

Deaths threats and online harassment against Jewish reporters like Ioffe continued throughout the 2016 campaign.
Jonathan A. Greenblatt, CEO and national director of the Anti-Defamation League, wrote in a Washington Post piece today: "It is shocking to us that in this day and age, the president will not acknowledge -- much less condemn -- the rise in anti-Semitic rhetoric and actions. The issue of anti-Semitism is not a political one. But it is potentially lethal. With the president's leadership, it can get better. With his neglect or instigation, it can get worse."
